Siemens v GE

Tom Mitcheson KC, Stuart Baran and Alice Hart acted for GE in this patent infringement and revocation action against Siemens. Meade J found Siemens’ patent invalid for obviousness and not infringed by GE’s Haliade-X wind turbines. The judgment ([2022] EWHC 3034 (Pat)) explores issues such as reliance on the prosecution history on the question of construction and the territorial reach of the Patents Act 1977, and in particular the circumstances in which it extends to acts undertaken on the Continental Shelf (the location of Dogger Bank, the site at which GE’s wind farms were to be erected).
