M&S has won its widely publicised registered design infringement appeal against Aldi, in respect of its light-up gin bottles.

It is rare for registered design cases to go to Court, and the judgment provides welcome clarity on the interpretation of registered designs, priority and the relevance of the grace period to infringement.
