Judgment in Geofabrics v Fiberweb Damages Inquiry

Geoffrey Pritchard, Charles Brabin and Alice Hart acted for Fiberweb in this damages inquiry following the finding of infringement of Geofabrics’ anti-pumping geocomposite trackbed liner patent.

In the judgment, Charlotte May KC (sitting as a Deputy High Court Judge) provided a useful summary of the legal principles applicable to damages inquiries, including on issues such as causation and remoteness of damage and “loss of a chance”. The Judge also issued an encouragement to parties generally to look for opportunities to enable junior counsel to undertake oral advocacy, as Charles Brabin and Alice Hart had both done on discrete points of closing in this case.
