Simon Malynicz KC, Geoffrey Pritchard and Daniel Selmi acted for The Swatch Group in their case against Samsung, who were found liable for third party watch face apps bearing The Swatch Group’s famous watch Swiss brands like Omega, Longines and Tissot, on their app store.

The case is the most recent milestone in the development of trade mark use and the “hosting” defence under the e-Commerce Directive.
